Terms and Conditions of Use of Roman Grinberg’s Arrangements & Orchestrations

This is a Legal Agreement between the end user and Roman Grinberg. By receiving musical arrangements from Roman Grinberg, Roman Grinberg’s Website or Roman Grinberg’s Online Webshop, you are agreeing to be bound by the terms of this agreement.

1. GRANT OF LICENSE: This License Agreement (“License”) permits you to use the arrangements under the following conditions:

2. USAGE: The Arrangement can be used and adapted/edited for your personal and professional use that includes rehearsals, live performances and recordings limited to 1 (one) choir/band/orchestra of your choice.

3. COPYRIGHT: This License is not an assignment of any rights of the copyright in the work. All copyrights and title associated with the Arrangement and its associated documentation (i.e. -lyric files, either as printed matter or in any other format) remains the sole property of Roman Grinberg and his fellow arrangers. International copyright law protects all Arrangements available from the web site. You may make as many copies of the Arrangements as you need, but solely for backup or archival purposes.

4. RESTRICTIONS:

  1. You may use the ARRANGEMENT with 1 (one) choir or band or orchestra of your choice.
  2. You may not swap, give away, loan, rent, lease, transfer (including any type of electronic transmission), dispose of or allow the arrangement to be distributed in any manner which could morally or financially damage Roman Grinberg or any of his fellow arrangers.
    This applies to both the original arrangements of Roman Grinberg and arrangements of Roman Grinberg, which you have edited/adapted.
  3. You may not publish any adapted/edited arrangements in any way.
  4. Any changes do not give you the right to put your name on the arrangement originally written by Roman Grinberg or one of his fellow arrangers. However, you are authorized to use the following wording: Based on the arrangement by Roman Grinberg, Vienna.
  5. For every public performance and every published recording, Roman Grinberg must be appropriately named as arranger whenever his arrangements are used. This applies to entire works as well as to shortened versions.
  6. For every upload to YouTube, Social Media or any Streaming Service, Roman Grinberg must be named in writing as the arranger if his arrangements are used. This applies to whole works as well as abstracts.

5. CUSTOMER REMEDIES:
In the event of a download error being detected during the transfer of a valid order, Roman Grinberg will re-send to the customer a duplicate of the affected file(s) or the entire order.

No other warranties: To the maximum extent permitted by applicable law, Roman Grinberg disclaims all other warranties, either express or implied, including but not limited to implied warranties of merchantability for a particular purpose, with respect to the arrangement.

No liability for consequential damages: To the maximum extent permitted by applicable law, Roman Grinberg shall not be liable for any other damages whatsoever arising out of the use of or inability to use any of his products. Roman Grinberg’s entire liability under any provision of this agreement shall be limited to the amount actually paid by you for the arrangement.

This is a Legal Agreement between the end user and Roman Grinberg. By receiving lead sheets from Roman Grinberg, Roman Grinberg’s Website or Roman Grinberg’s Online Webshop, you are agreeing to be bound by the terms of this agreement.
